Rental Agreement
This Rental Agreement is made effective as of the date of reservation by and between Doyen Properties South, (“landlord”), and the person making the reservation, (“tenant”). The parties agree as follows.
PREMISES. Landlord in consideration of the rental payment provided rents to tenant a two-bedroom house (“the premises”) located at 31 Wave Walker Ln, Surry, Maine. Wave Walker Ln is on Newbury Neck.
FURNISHINGS. The rental of the premises includes furnishings. Kitchen utensils and place settings are provided. Linens and towels are included. Pets are not permitted. Tenant agrees to maintain the condition of the furnishings and not cause any damage except for such deterioration that might result from normal use.
TERM. The lease term will be from the check in to the check out date.
RENTAL PAYMENTS. Tenant agrees to pay landlord $350 per day, cleaning fee of $175.00, and Maine tax of 9%. The total cost will be determined at the time of the reservation. Full payment is due upon signing this agreement. Payment can be made via check or electronically through this website or third party vendors (AirBnB or VRBO).
SECURITY DEPOSIT. The security deposit is $250.00. The security deposit is required to reserve your week(s). The security deposit is returned the next business day after the end of your rental term provided the house is not damaged and is reasonably clean.
CANCELLATION. If guest cancels more than 60 days prior to the start of the reserved week, the security deposit and any rental fee paid will be refunded in full. If guest cancels less than 60 days prior to the start of the reserved week, the security deposit will be refunded, any rental fees paid will be refunded only if we are able to rent your reserved week(s) to another prospective guest. Upon receiving your request to cancel we will make the property available to other prospective guests.
CLEANING. There is a $175.00 cleaning fee. Landlord agrees to provide to tenant the premises in a clean condition. Tenant agrees to leave the premises in a reasonably clean condition, laundry started, and dishwasher started.
POSSESSION. Tenant shall be entitled to possession on the first day of the term of this Rental Agreement after 4:00 p.m. Tenant shall yield possession to the landlord on the last day of the term no later than 10:00 am, unless otherwise agreed to by both parties in writing
UTILITIES AND SERVICES. Landlord shall be responsible for all utilities and services in connection with the premises.
ASSIGNABILITY/SUBLETTING. Tenant may not assign of sublease any interest in the premises without prior written consent of the landlord, which shall not be unreasonably withheld.
ENTIRE AGREEMENT/AMENDMENT. This Rental Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written.
This Rental Agreement may be modified or amended in writing, if the writing is signed by the party obligated under the amendment.
SEVERABILITY. If any portion of this Rental Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Rental Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced so as limited.
CUMULATIVE RIGHTS. The rights of the parties under this Rental Agreement are cumulative and shall not be construed as exclusive unless otherwise required by law.
GOVERNING LAW. This Rental Agreement shall be construed in accordance with the laws of the State of Maine.
